El presente estudio expone la regulación del nuevo delito de "atti persecutori" introducido en el Código Penal italiano. El Decreto Legge 11/2009, de 23 de febrero, convalidado por el Parlamento italiano mediante la Ley 28/2009, ha incluido un nuevo art. 612 bis al CP italiano. Con la inclusión de dicho delito entre los que protegen la libertad del individuo Italia se incorpora a la corriente político-criminal que propugna la criminalización del stalking. La incriminación de dichas conductas de acoso constituye una orientación iniciada en Estados Unidos a principios de los 90, que ha colonizado otros países del Common Law y que finalmente ha llegado a la Europa continental. En este trabajo se analizan básicamente los elementos del tipo del nuevo delito italiano. Sin embargo, no se deja de atender ni a la previa conceptuación de este fenómeno ni a otras medidas protectoras de la víctima del stalking que se incorporan al ordenamiento italiano mediante la presente Ley.
The study describes the regulation of the new crime of "atti persecutori" introduced in the Italian Criminal Code. The Decretto-Legge 11/2009, of 23th February, ratified by the Italian Parliament in the 28/2009 Act, has included a new 612 bis section at the Italian Criminal Code. With the inclusion of such crime, as the other than protect the freedom of the individual, Italy joins to a new criminal policy trend that proposes the criminalisation of stalking. The criminality of such harassment behaviours is targeting the United States in
the early 90's, which has colonized other countries of the Common Law that has finally arrived to Continental Europe. This article analyzes basically the elements of the new type of the new italian crime. However, it includes also locations to conceptualise this phenomenon and it is also pointed to these other measures in order to protect the victims of stalking that have been included into the italian Law through
this Act.
Das vergelegte Studium stellt die Regulierung des neuen Verbrechens des "atti persecutori" im
italienischen Strafgesetzbuch vor. Das Decretto-Legge 11/2009 vom 23. februar, das vom italienischen Parlament durch das Gesetz 28/2009 als gültig erklärt wird, hat einen neuen Artikel 612bis im italienischen Strafgesetzbuch eingeschlossen. Mit der Einsbeschliessung des erwähnten Verbrechens zwischen denen, die die Freiheit der Person schützen, gliedert sich Italien in die vorliegende Kriminal-Politik ein, die für die Kriminalisation des Stalking eintritt. Die Beschuldigung von erwähnten
Belästigungsverhalten stellt eine Orientierung dar, die in den Vereinigten Staaten Anfang der 90ziger Jahre eingeführt wurde, und die andere Länder des "Common Law" kolonisiert hat und das endgültig in Europa Kontinental angekommen ist. In dieser Arbeit werden grundsätzlich die Elemente der neuen Art des italienischen Verbrehens analisiert. Trotzdem wird sowohl der vorhergende Begriff dieses Phänomens als auch die anderen Schutzmassnahmen der Opfer von Stalking, die in der italienischen Verordung durch das vorgelegte italienische Gesetz, berücksichtigt. |
