La propuesta de reglamento comunitario concerniente a una normativa común sobre
compraventa europea, hecha pública por la Comisión Europea en octubre de 2011, parece haber agotado su recorrido en diciembre de 2014, cuando, en el calendario de trabajo para el siguiente ejercicio, la propia Comisión anuncia su transformación en una iniciativa legislativa más amplia dirigida a regular, desde diversos puntos de vista, el mercado único digital. Esta reconducción se ha confirmado en mayo de 2015, al haberse comprometido la Comisión a presentar antes de que finalice el año una propuesta
para armonizar las reglas europeas relativas al comercio electrónico transfronterizo de contenidos digitales.
Queda por ver si este renovado proyecto será una simple adaptación del anterior a las características de la contratación en línea o, si al menos en parte, se tratará de un articulado de nueva factura. Tanto en uno como en otro caso, sin embargo, el texto resultante debería incorporar diversas mejoras técnicas que, en aspectos como la opcionalidad de la regulación o los ámbitos de aplicación de la misma, evitaran la reaparición de algunas de las deficiencias que eran perceptibles en la normativa común de compraventa
europea.
The Proposal for a Regulation on a Common European Sales Law, released by the European Commission
in October 2011, seems to have run its course in December 2014, when, in the Work Programme
for 2015, the Commission announced its transformation into a wider legislative initiative to
regulate, from various points of view, the Digital Single Market. This readjusting was confirmed in May
2015, when the Commission has undertaken to submit before the end of the year a proposal to harmonise
the European rules on cross–border e–commerce of digital content. It remains to be seen whether this renewed project will be a mere adaptation of the former to the characteristics of online purchases
or if, at least in part, it will be a brand new regulation. In either case, the resulting text should incorporate
several technical improvements concerning issues such as the optional character of the regulation
or its scope of application, in order to avoid the reiteration of some of the deficiencies that were noticeable
in the Proposal for a Regulation on a Common European Sales Law.
