La reciente aprobación de la Ley 12/2011, sobre responsabilidad civil nuclear y de sustancias radiactivas, hace necesario un examen profundo y actualizado de la actual regulación a la luz de las modificaciones practicadas respecto de la Ley de 1964 y de la situación internacional creada a raíz del accidente de Fukushima. El artículo se encarga de analizar la responsabilidad de los explotadores de las instalaciones, así como las excepciones, procedimientos de reclamación y los límites indemnizatorios de esta responsabilidad civil objetivaen nuestro país.
The recent approval of Act 12/2011, on Civil Liability for Nuclear and Radioactive Substances, demands a thorough and updated review of the current regulation in light of the amendments made in respect of the Act 25/1964 and the international situation created following the Fukushima accident. The article analyzes the responsibility of the nuclear and radioactive installations’ operators, the exceptions, claim procedures and compensation limits of this strict liability in Spain |
