La col·laboració amb les entitats privades en la gestió dels serveis socials presenta uns caràcters específics i singulars degut als atributs que caracteritzen aquesta classe de serveis. Tradicionalment la vinculació entre l’administració competent i el prestador del servei es formalitza per mitja d’un contracte, en concret, el concert. Faltarà veure si tal negoci jurídic és diferent al «concert social» dibuixat per les normatives autonòmiques en matèria de serveis socials el qual destaca, a banda de la incertitud sobre la seva naturalesa jurídica, per seu tracte a favor de les entitats sense ànim de lucre. Dit això, s’haurà de tenir present la nova Llei de Contractes del Sector Públic a fi d’examinar si s’adopten els canvis normatius introduïts per les Directives Comunitàries en matèria de serveis socials. En l’eventual hipòtesis d’una resposta negativa a l’afirmació anterior, caldrà estudiar l’adaptació del concert social al marc dibuixat per la normativa de contractació administrativa.
The collaboration with private entities in social services manage has specifics and singulars characters due to the attributes that characterize this class os services. Traditionally the link between competent administration and services provider is formalized by a contract, in particulary, the agreement. It will be lacking to see if such a legal transaction is diferent form the «social agreement» drawn by the autonomous regulations in social services matter whom stand out, in spite of that the uncertainty about its legal nature, for its treatment in favor of nonprofit organizations. Having said that, must be taken into account the new Public Sector Contracts Law in order to examine whether the regulatory changes introduced by the Community Directives on social services matter. In the possible hypothesis of a negative answer to the previous statement, it will be necessary to study the adaptation of the social agreement to the framework drawn up to the públic procurement and concessions contracts regulation. |
