Reflexions sobre una eventual reforma de la llegítima

Abstract

L’objecte d’aquest working paper és contribuir a la discussió sobre una reforma en profunditat de les llegítimes, tant en dret espanyol com en dret català, que contribueixi a dotar el causant de major llibertat de testar, així com a assegurar que el principi de solidaritat intergeneracional es manifesta en les circumstàncies que realment ho requereixen. Així, després d’una anàlisi de dret comparat i l’ús de les estadístiques més rellevants, no es proposa una llegítima alimentària a mode d’un dret d’aliments successoris, sinó una llegítima de quota fixa els beneficiaris de la qual siguin únicament els menors de vint-i-cinc anys, els incapacitats i discapacitats.

This working paper aims at contributing to the debate on a reform in depth of the compulsory share both in Spanish law and in Catalan law. The system should guarantee freedom of testation but also the intergenerational solidarity between relatives in such situations where its concretion is really needed. The author comparatively scrutinises the European laws of succession and the most significant statistics in Spain. On this basis, the proposal denies to shape the compulsory share as a right of alimony. Instead, a fixed share only in favour of descendants is to be preferred, provided that the descendants are aged under 25 years, incapables or disabled.
