Mass Fish Deaths in Aquarium and the Legal Response in Japan

Abstract

In this document Ms. Honjo analyses the case of the poisoning of over 1000 fish by a former aquarium worker in the Saitama prefecture. The author highlights how the case, which has incurred no legal repercussions or obligations for the aquarium, shows loopholes in the Standard for Rearing and Exhibiting Animals in Japan. The man arrested is charged only with damage to property, as the lives of the fish are only measured in economic terms. This, among other factors, such as the non-legally binding status of the Standards for Rearing and Exhibiting Animals, highlight the need for stronger standards of fish and animal welfare in Japan.

En este documento la Mag. Moe Honjo analiza el caso del envenenamiento de más de 1000 peces ocasionada por un ex empleado de un acuario radicado en el territorio de Saitama. El autor resalta principalmente como este caso, en el cual no hubo repercusiones ni responsabilidades legales para el acuario, revela lagunas en la Norma para la cría y exhibición de animales en Japón. El detenido está acusado solamente de daño a la propiedad, pues la vida de los peces sólo ha sido medida en términos económicos. Esto, entre otros factores, tales como que esta norma - Norma para la cría y exhibición de animales- no es jurídicamente vinculante, establece notoriamente la necesidad de unas normas más fuertes de bienestar de los animales y asimismo protejan al pescado en Japón.
