Política i justícia constitucional : els magistrats del Tribunal Constitucional segueixen criteris polítics?

El rol institucional i els criteris d’actuació del Tribunal Constitucional han estat al centre del debat públic els darrers anys. Aquest treball estudia el comportament dels magistrats del Tribunal Constitucional d’Espanya en relació als interessos dels partits polítics que han participat en la seva designació. L’estudi parteix del model actitudinal del comportament judicial, que assumeix que els jutges actuen seguint criteris ideològics. Per a la investigació s’analitzen els vots particulars dels magistrats mitjançant tècniques quantitatives.

The institutional role and the acting criteria of the Constitutional Court have been in the center of the public debate during the last years. This research studies the behavior of the judges of the Spanish Constitutional Court in relation to the interests of the political parties that have participated in its designation. The investigation departs from the attitudinal model of judicial behavior, which assumes that judges act following ideological criteria. We study the particular votes of the judges through quantitative methods.
